General terms and conditions

For all services provided by LEITNER ERGOMÖBEL GmbH for consumers and entrepreneurs, the following GTC apply.

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

With respect to entrepreneurs, these GTC shall also apply to future business relations without our having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby objected to; they shall only become an integral part of the contract if we have expressly agreed to them.

The purchase contract is concluded with LEITNER ERGOMÖBEL GmbH, Burgwegerstraße 57, 4923 Lohnsburg.

The offers of LEITNER ERGOMÖBEL GmbH in the online store are non-binding offers to the customer. Errors excepted. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained for this purpose in the ordering process.

In the online store, the contract is concluded when you accept the offer for the goods in the shopping cart by clicking the order button [zahlungspflichtig bestellen]. Immediately after sending the order, you will receive another confirmation by e-mail, which is also the order confirmation. In case of payment in advance, the order confirmation contains the transfer amount and the bank details.

When ordering by e-mail or telephone, the order is concluded by sending the order confirmation.

Consumers have the right to cancel the contract within 14 days without giving any reason. Entrepreneurs are not granted a voluntary right of withdrawal.

Right of withdrawal
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

by means of a clear declaration (e.g. a letter sent by mail or e-mail) about the decision to revoke this contract. To do so, you can use the attached form on our website. Sample cancellation form or our Use online form , which is not mandatory.

If you make use of this option, we will send you a confirmation of receipt of such revocation without delay (e.g. by e-mail).

In order to comply with the withdrawal period, it is sufficient that the customer sends the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received notification of the withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

We may refuse to refund you until we have received the goods back or until you have provided proof that the goods have been returned, whichever is the earlier.

You must return or hand over the goods to us immediately and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days

We bear the cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to your handling the goods in a way that is not necessary for the inspection of the condition, properties and functioning of the goods.

Please avoid damage and contamination. If possible, please return the goods to us in the original packaging with all accessories and with all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.

Please note that the above modalities are not a prerequisite for the effective exercise of the right of withdrawal.

The gross sales prices stated on the product pages include the statutory sales tax and other price components.

To the indicated product prices are added Shipping costs added. You can find out more about the shipping costs on the product pages.

Delivery is usually made by parcel service to the first lockable door of the delivery address or by freight forwarding “free curbside” to the shipping address specified by you (exception see above under point Shipping to other countries).

The delivery time is up to 5 days. We point out deviating delivery times on the respective product page.

The invoice will be sent by e-mail when ordering in the online store. When shipping on account, the invoice receipt is transmitted in a shipping bag on the package for individual packages. In case of multiple packages (delivery on pallet), the invoice will be sent by e-mail.

The delivery time indicated with the articles begins with the dispatch of the order confirmation.

In case of payment in advance, the delivery time starts with the receipt of the amount to be paid in advance according to the order confirmation on the bank account of LEITNER ERGOMÖBEL GmbH.

If an item is not available at short notice or if an extension of the general delivery time is necessary due to an increased order volume or other circumstances, you will be informed of this by e-mail. If you do not agree with the delay in delivery, you can withdraw from the contract by notifying us by e-mail or returning the order confirmation with a note to that effect without any restrictions.

For consumers applies:
The risk of accidental loss and accidental deterioration of the goods shall pass to the customer upon handover to the customer.
If goods are delivered with obvious transport damage, please complain about such defects to the delivery person as soon as possible and contact us immediately. Failure to make a complaint or contact us will have no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or transport insurance.

For entrepreneurs applies:
The risk of accidental loss and accidental deterioration shall pass to you as soon as we have delivered the item to the forwarding agent, the carrier or the person or institution otherwise designated to carry out the shipment. Among merchants, the obligation to inspect and give notice of defects regulated in § 377 of the Austrian Commercial Code (UGB) shall apply. If you fail to notify us as stipulated therein, the goods shall be deemed to have been approved, unless the defect was not recognizable during the inspection. This does not apply if we have fraudulently concealed a defect.

Unless otherwise agreed in writing, our claims are to be paid in full and without deduction before delivery of the ordered products. The following payment methods are available for purchase in our store: Cash or ATM. The purchase price is due in each case immediately upon acceptance of the offer. A payment of the purchase price when buying through our online store is possible by means of the following payment methods:

Payment in advance:
You transfer the invoice amount to the specified account within 1 week after the conclusion of the contract. Bank charges are at your expense.

Payment by credit card:
If you select the credit card payment method, your credit card will be charged upon completion of the order. For more details on credit card payment, please see the privacy policy.

After placing the order you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via Paypal, you must be registered there or register first, legitimize with your access data and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction is carried out automatically by PayPal immediately afterwards.

Payment on account:
After receiving the delivery, you have to pay the invoice amount by means of the enclosed invoice within the specified payment period.

During the ordering process you will be informed in detail about the possible payment methods.

The goods remain our property until full payment.

For entrepreneurs, the following shall apply in addition: We shall retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you assign to us in advance all claims arising from this resale – irrespective of any combination or mixing of the goods subject to retention of title with a new item – in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the receivables, but we may also collect receivables ourselves if you fail to meet your payment obligations.

The statutory warranty provisions shall apply.

A warranty period of 3 years is granted for LEITNER ERGOMÖBEL GmbH’s own products. It does not apply when purchasing via internet auctions. The warranty applies to original parts for all material and functional defects. Excluded are fabric covers as well as the usual wear and tear of wear parts and damage resulting from improper handling (including care errors, impact, scratch and tear damage). In case of warranty LEITNER ERGOMÖBEL GmbH will repair or replace without charge. Only transport costs are not covered.

Online dispute resolution pursuant to Art. 14 para. 1 ODR REGULATION: The European Commission provides a platform for online dispute resolution (ODR), which you can access at find. Consumers have the  option of contacting the EU Commission’s online dispute resolution service (see above for web address) for the resolution of their disputes at . We are not obliged to participate in dispute resolution proceedings before this body. We will not participate in such a procedure.

The contracts concluded under inclusion of these GTC are subject to Austrian law. The UN Convention on Contracts for the International Sale of Goods  does not apply .
The German version of these General Terms and Conditions shall prevail. The English version is for information only.

Any action brought against a consumer who has his domicile, habitual residence or place of employment in Austria on account of disputes arising from this contract shall be subject to the jurisdiction of one of the courts in whose district the consumer has his domicile, habitual residence or place of employment. For consumers who are not domiciled in Austria at the time of conclusion of the contract, the statutory places of jurisdiction shall apply.

If the customer is an entrepreneur, the place of jurisdiction shall be Ried i. I. (Austria).

Should any point of these terms and conditions be void or voidable, the validity of the remaining terms and conditions shall not be called into question.
